As noted previously two borrowers had recently applied to the Court of Appeal for permission to appeal against the dismissal of allegations of unfair relationship arising out of the sale of PPI. The decisions which were challenged had robustly applied the Court of Appeal ruling of Harrison v Black Horse.
Permission has been granted in both by Pitchford LJ and the appeals will be listed together. The Supreme Court actually gave permission in Harrison v Black Horse only for the appeal to be subsequently compromised. The credit industry will hope this development reflects more a desire to ensure full judicial consideration is given to this troublesome section of the CCA than any strength of these particular appeals.
